“If someone owes you money, it is important you move fast to recover it or you could find yourself becoming just another unsecured creditor of Britain’s growing number of insolvent individuals,” warns Richard Kerry, one of Hatchers’ top litigation lawyers.

“Thirty thousand people are expected to become insolvent between January and the end of March 2007. By the end of the year the figure will top the 100,000 seen in 2006, due to greater borrowing and higher interest rates and utility bills.
“Once individuals have become bankrupt or entered into an individual voluntary arrangement (IVA) it is not possible to issue proceedings against them to recover the sums they owe, so don’t be fobbed off by bad payers, institute proceedings before it is too late. Debt recovery proceedings are about the most straightforward form of litigation and costs are relatively modest compared with other types of litigation.
